Decision on Renewal of License For Club Malibu Postponed Again

SCOTCH PLAINS — The question of whether to renew the liquor license of Club Malibu in Scotch Plains will drag into the new year, after last week’s postponement of a hearing before the Township Council, the fourth such delay in three months.

Rayric Corporation, which operates the Terrill Road nightspot, which was the scene of a fatal shooting on November 27, 1998, requested last Thursday’s postponement; a new hearing is now set for Thursday, January 6. Both Township Attorney Andrew M. Baron and Neil Cohen, counsel for Rayric Corporation, declined to comment on any specifics of the matter.

But Thomas F. O’Brien, Scotch Plains Chief of Police, told The Times his department wouldn’t necessarily oppose renewal of Malibu’s liquor license “as long as some of the concerns we expressed to the Township Council are addressed.” He said the Police Department’s primary concern is

“people being allowed to congregate in the parking lot, waiting to get in. We wanted that curtailed.”

Both the Police and Fire Departments, Chief O’Brien said, want fire lanes and fire code issues addressed as well “to make sure there’s no overcrowding” inside the club.

The initial hearing on the renewal, which must be approved by the council in its role as Alcoholic Beverage Control Board, was scheduled for September 14, but adjourned. Subsequent hear ings set for October 21, December 2

and last Thursday were also canceled, at Rayric Corporation’s request. There is some speculation that Rayric is trying to avoid a public hearing, and an airing of local residents’ complaints about conditions inside and outside of Club Malibu, and instead work out a private deal.

The nightclub has been closed since January and was the subject of complaints about overcrowding and rowdy behavior.

· An unidentified individual fired a yellow paint ball at a home in the 80 block of North Glenwood Road, leaving a stain on the exterior of the residence.

THURSDAY, DECEMBER 9

· Authorities said someone defaced the field house at Forest Road Park with white spray paint.

· An unidentified woman unsuccessfully attempted to make a purchase from a North Avenue eatery using what police described as an “obviously phony” $100 bill.

The woman was described as white, 5 feet and eight inches tall, between 125 and 135 pounds, with short brown hair. She was wearing a threequarter length brown coat and blue jeans during the incident at the North Avenue establishment.

Police said the woman was last seen walking west on North Avenue, but patrols failed to locate her.

· A bicycle was reported stolen from the 40 block of Trenton Avenue.

· Lawrence Nicholson, 36, of Boonton was charged with a disorderly persons offense at the Fanwood train station for allegedly boarding the train at an earlier stop after being told to get off. Nicholson had been asked to leave the train because he had brought a fullsize bicycle on board, police said. He was issued a summons and released on his own recognizance.
