Invitations are extended to qualified Bidders to initially bid for the following Project:
Barrier-Free Improvements to Counselor’s Shed at Green Forest
Park, Scotch Plains, New Jersey Bids will be accepted by mail or in person at the Scotch Plains Municipal Building, 430 Park Avenue, Scotch Plains, New Jersey 07076 (ATTN: Barbara Riepe, Township Clerk) until March 4, 1999 at 10:00 a.m. At that time, the bids will be publicly opened and read aloud. All bids must be presented in sealed envelopes which are clearly marked “Barrier-Free Improvements to the Counselor’s Shed at Green Forest Park, Scotch Plains, New Jersey 07076.” No bid will be received after the time and date specified.
After receipt of bids, no bid may be withdrawn within sixty (60) days after the date of the bid opening except if provided forth herein. The bid of any Bidder who consents to an extension may be held for consideration for a longer period of time as may be agreed upon between Bidder and the Township.
All bids must be on the bid forms provided by the Township of Scotch Plains in the Bid Package. Architectural Plans, Specifica
tions, Instructions to Bidders and Proposal Forms may be obtained at the MJBarone and Associates, P.C., 24 Ellingham Avenue, Monroe Township/Jamesburg, New Jersey, between the hours of 9:00 a.m. and 5:00 p.m., Monday through Friday for a nonrefundable fee of Seventy-five Dollars ($75.00) made payable to “MJBarone & Associates, P.C.” No documents will be mailed. Bids will be made on the Proposal Form in the manner designated herein and required by the Specifications.
Bid proposals and all required documents must be completed and submitted by the date as set forth above. All documents in the enclosed Bid Package must accompany the bid proposal.
In addition to the above documents, a certified check, cashier’s check or bid bond issued by a responsible bank, trust company or insurance company, payable to the Township of Scotch Plains shall be submitted with each bid as a guaranty that if a contract is awarded, the Bidder shall execute said Contract and furnish the bonds required by the Contract Documents (“Bid Security”). The Bid Security shall be in the amount of ten percent (10%) of the total amount of the bid or Twenty-Thousand Dollars ($20,000.00), whichever is lower.
All Bid Security, except the Bid Security of the three (3) apparent lowest responsible Bidders shall, if requested in writing, be
returned after ten (10) days from the opening of the bids (Sundays and holiday excepted) and the bids of such bidders shall be considered withdrawn.
The Township reserves the right to reject any or all bids. The Township will evaluate all bids and any award will be made to the lowest responsible Bidder whose bid conforms to this solicitation.
The selected Bidder will, within three (3) days of award of the bid, enter into an appropriate contract with the Township.
All Bidders must comply with P.L. 1975, Chapter 127, entitled “An Act Relating to Affirmative Action in Relation to Discrimination in Connection with Certain Public Contracts and Supplementing the ‘Law Against Discrimination’ approved April 16, 1945 (P.L. 1945, Chapter 169), N.J.A.C. 17:27, as amended from time to time, and the Americans with Disability Act.
Where applicable, prevailing wage rate shall be paid to all workers on the job as per N.J.A.C. 34:11-56, 25 et seq.

TOWNSHIP OF SCOTCH PLAINS RESOLUTION 98-1 EXPLANATION: This Resolution authorizes the Law Firm of Bivona, Cohen, Kunzman, Coley, Yospin, Bernstein & DiFrancesco to continue to represent the Township of Scotch Plains on certain legal matters.
WHEREAS, by Resolution No. 98-1 the Township Council of Scotch Plains retained the services of Bivona, Cohen, Kunzman, Coley, Yospin, Bernstein & DiFrancesco, as Township Attorney for Scotch Plains; and
WHEREAS, on January 1, 1999, a new Township Attorney was appointed by the 1999 Township Council of Scotch Plains; and
WHEREAS, certain matters which were being handled by the Bivona, Cohen firm are or will be nearing completion during the course of 1999; and
WHEREAS, the complexity and extent of work previously performed on certain matters by the Bivona firm warrants continued utilization of the Bivona firm on a limited number of cases; and
WHEREAS, the Township of Scotch Plains will require the services of the law firm on these matters during 1999; and
WHEREAS, the Local Public Contracts Law (N.J.S.A. 40A:11-1, et seq.) requires that the resolution authorizing the award of a contract for professional services without competitive bids must be advertised;
NOW, THEREFORE, BE IT RESOLVED,
by the Township Council of the Township of Scotch Plains, Union County, New Jersey,
that Bivona, Cohen, Kunzman, Coley, Yospin, Bernstein & DiFrancesco, 15 Mountain Boulevard, Warren, New Jersey 07059, be appointed as Special Council retroactive from January 1, 1999 through December 31, 1999.
This contract is awarded without competitive bidding as a “professional service” under the provisions of said Local Public Contracts Law because the services are of such a qualitative nature and will not permit the receipt of competitive bids due to the subjective difference in the work product of such persons and the fact that the ethical requirements of such profession will not permit such bidding; and
BE IT FURTHER RESOLVED, that the Mayor and Clerk are hereby authorized to sign any and all contract documents with the firm of Bivona, Cohen, Kunzman, Coley, Yospin, Bernstein & DiFrancesco after a mutually acceptable agreement has been prepared by the Township Attorney based on cost projections provided by the Bivona law firm.
The availability of funds in connection with this Resolution and said contract is subject to and contingent upon final passage and adoption of the 1999 Budget by the Township Council of the Township of Scotch Plains.
A copy of this resolution shall be published in The Times as required by law within ten (10) days of its passage.

Westfield Library Sets Internet Training Class
WESTFIELD — The Westfield Memorial Library will hold two classes on Internet searching techniques. Individuals may register for either the Tuesday morning session on February 23 at 9 a.m. or the Wednesday evening session on February 24 at 7:30 p.m.
The presentation, which will be given by the library’s reference staff, is a hands-on introduction to the Internet and will also include instruction on using EBSCOhost, an on-line magazine database.
In-person or telephone registration will begin on Tuesday, February 16, at the Circulation Desk for both classes. A valid Westfield Library card will be required to attend.
